Though yes technically your likeness can be used while in a public space.

this guy isn't breaking any of the "laws" mentioned in that article. and if he was, he'd be punished and wouldn't make any more videos. and no, people are not allowed to film in public because of the first amendment. the problem with the term "harassing" is that it is left open to interpretation. some people would consider others looking at them to be harassment.
