Poor Framerate with DX9 Fire

Ok, so I am having a problem with Fire in DX 9 (-dxlevel 90 and above)

Specifics
-Players at range on fire; minimal fps hit
-1 Player within Melee Range on fire +regular number of pub players not on fire; I drop from 110ish frames to 80ish
-2 Players within Melee Range on fire +regular number of pub players not on fire; I drop from 110ish frames to 55ish.
-1 Player right ontop of me (Same team) while on fire, regardless of number of other players; I drop from 120ish frames to 40ish.

This problem doesn't occur in DX 8.1 even with the same config.

Things I've tried:
-Restarting
-Updating Drivers
-Trying multiple DX 9 levels (dxlevel, 90, 91, 95, 98)
-Trying multiple configs, MaxQuality, Dx9Frames, MaxFrames, a Custom 1 I built
-Trying multiple Systems
-Changing individual commands

    mat_reduceparticles
    mat_reducefillrate
    mat_parallaxmap
    mat_picmip
    mat_forceaniso
    mat_filtertextures
    mat_specular
    r_threaded_particles
    [b]-Commands that I knew shouldn't change it but tried anyway-[/b]
    mat_aaquality
    mat_antialias
    mat_hdr_level
    mat_trilinear

System 1: (This is the main system I used for FPS numbers)
CPU: i7-2630QM @ 2.0GHz
RAM: 8GB DDR3 1600
GPU: GTX 540m 1GB GDDR3
(yes it's a laptop, and yes I have fixed my power settings)

System 2:
CPU: AMD Phenom II x4 940 @ 3.2GHz
RAM: 6GB DDR2 1066
GPU: Sapphire HD 6670 1GB

Does anyone know of a fix for this?

Bump, seriously I really would like to run this game in DX 9, so I can update my drivers for my laptop GPU (you have to use seriously outdated drivers to get DX 8.1 to not have a strobe effect for Nvidia cards).

I have the latest nvidia drivers with my Nvidia GTX 650 and tf2 works normally with dx8. I submitted a bug report long ago when it first was found detailing it to nvidia and i think they actually fixed it for the 600 series. You could try report it too with your system information and get dx8 working as an alternative solution. Take what you will if you believe me.

I have the same issue, I don't know a fix unfortunately, so I'm hoping someone else knows of some sort of fix. My specs are:

CPU: i5 2500k @ 4.7 ghz
GPU: Radeon HD 6850
RAM: 8 gb
