that's one, the other being the huge racial/class disparity in who actually gets the death penalty in relation to the equal protection clause of the 14th amendment

if more justices were willing to use disparate impact, (aka scalia's replacement), you could easily see that being factored in in the futre

luckily there are several other reasons why the death penalty is unconstitutional

in many cases, I agree that people take their hatred for political figures to too much of a visceral, violent place, wishing physical harm on them and whatnot. however, it's not our fault that lifetime appointments lead to morbid discussions such as these. criticizing people for being happy that we have a chance of getting a supreme court that consistently votes 5-4 for progressive causes instead of 5-4 against, because of the human life that had to be lost for that reality to happen, is as inherently politically loaded an action as those people expressing happiness. if Scalia had simply retired (which he would've never done under a democratic president btw), that would've been a win-win. but at the end of the day, I don't think we need to let the standard obituary lines of "he was so charming and funny and him and Ruth Bader Ginsburg were BFFs" obfuscate the fact that he did a lot of damage in social and criminal justice issues.
