The plugin explicitly bypasses the plugin loading system on the client. I wouldn't risk my account on the basis of "but Valve wouldn't do that!". It's entirely possible that VAC is slowly banning people using it, all the confusion created is intended by the delayed ban system. Now, I hope they would notice a huge increase in bans for that particular plugin and do something more sensible about it, but nothing requires them to go back and unban the "early adopters", so to speak, that are already banned.

No, that's not how it works. The client will simulate the game (create user commands) at tickrate ticks per second, where tickrate is the server -tickrate configuration. In the case of TF2, it's locked to 66, so 66 ticks is one second.
