FPS stuttering while streaming with obs

i tried streaming again after a while (a few months) and whenever i try my fps stutters. It will drop from 200-300 one second down to 90-60 constantly and make tf2 unplayable. any answers would be helpful, i used to stream at these settings without lag now idk what is the problem as nothing has changed. I also have Chris's high fps config.

Specs:
OS: windows 7 home premium 64bit
Processor: AMD FX-4100 quad core processor 3.6GHz
GPU: amd radeon 7870
8gb of ram

Download speed- 50 Mb/s
Upload speed- 35 Mb/s

OBS settings:

Encoding:
quality- 7
CBR- enabled
max bitrate- 3000
buffer size- 3000

Broadcast settings:
US East: New York, NY (im in new jersey)

Video:
Res- 968x560
FPS- 40
Aero- disabled

Advanced:
multithreaded optimizations: on
Process Priority class: High
Disabled Encoding while previewing: off
x264 CPU preset: superfast
Use CFR: off
Custom x264 Encoder settings: off

Your processor is a little to weak, I would recommend the FX-8350 or an i7 3770k.
If you're unable to upgrade, I would lower the quality and change the recording FPS to 30.

that doesn't seem true because i've been able to stream at these settings before prefectly with no stutter but now it violently stutters whenever i try at these settings

Every tf2 update seems to make things worse.

You may try to lower the stream settings and see what happens then.

tried normal and turned on vsync and this made it playable but just not fun to stream so i'm just gonna wait for my processor upgrade to actually stream.. kinda a disappointment for me. :(

from what i saw you were using software capture on your stream
try using game capture, while it doesn't show overlays and whatnot, it runs the game much smoother than anything else.

try using game capture, while it doesn't show overlays and whatnot, it runs the game much smoother than anything else.

Is this feature in OBS? I'm new to all this and im having similar issues but in different games. If this is in OBS can someone tell me where?

select game capture by right clicking your sources and selecting game capture. name it anythin and then choose the game you're playing
