winpanel moves up freezepanel

I don't know if anyone else has noticed this but when the winpanel shows up at the same time as the freezepanel, the freezepanel gets moved up around 50 units. In my HUD the freezepanel's ypos is c40 and it collides with my HUD crosshair when the winpanel is displayed simultaneously.

Looking at the default HUD, it becomes understandable why Valve implemented this (normally the freezepanel is around 50 units lower and it would overlap with the winpanel): http://puu.sh/oAwP7/6d4c8e017b.jpg

My question: Is there a way to prevent the freezepanel from moving up when the winpanel is displayed at the same time?

There's no animation related to this. I've tried all positional changes you can think of, to no avail. Also, I've tried various ways of pinning elements to each other and it didn't change anything. Maybe somebody knows something or we can find a solution together.
